While the U.S. Supreme Court has adopted an increasingly pro-arbitration stance and has repeatedly reinforced the Federal Arbitration Act’s preemption powers, some states and courts, along with groups of current and prospective employees, have sought to counter that trend through court decisions and legislation.

Our panel, which is comprised of in-house counsel, outside counsel, and active arbitrators, will offer their perspectives on both current trends and practical considerations in commercial, consumer, employment and international arbitrations.

maya ewing

Maya Ewing is Director and Senior Managing Counsel at Allstate Insurance Company in Northbrook, Illinois. In her current role, Ewing leads the Employment and Benefits Team responsible for employment-related litigation and for providing legal counsel to Human Resources and Allstate business units. Ewing joined Allstate in 2002 and has held a variety of positions in Corporate Litigation, Corporate Law and Insurance Operations Law divisions, while successfully directing several key initiatives for the corporation. During her tenure at Allstate, Ewing has led a multitude of employment class action litigation and complex insurance business initiatives, as well as co-chaired the law department’s Inclusive Diversity Council.

Casey D. Laffey

Casey is avice chairof Reed Smith’s Global Commercial Disputes Group where he specifically focuses on talent development and oversees the recruitment, retention and development of talent at every level of the practice group across the firm’s United States offices.

Anna Wermuth

Anna serves as the vice chair of the firm’s national Labor & Employment Department. Anna represents management in labor and employment litigation before state and federal courts and administrative agencies such as the EEOC, the Department of Labor, and the National Labor Relations Board. Anna has extensive experience representing employers in individual and large-scale class actions involving the full range of employment-related disputes, including discrimination, wage and hour, non-compete agreements, and unfair labor practices. Anna also regularly counsels employers on maintaining compliance with state and federal laws and regulations, assists employers with developing employment policies and executing human resources strategies, negotiates employment and separation agreements, advises employers in connection with reductions in force, and has conducted numerous internal investigations.

Heidi Swartz

Heidi Swartz currently leads the Employment Law & Investigations Team in Facebook’s Legal department. Facebook’s Employment Law & Investigations Team is a global team with members in APAC, EMEA LATAM, and the US advising on all matters related to employment from hire to termination, including harassment and discrimination complaints and investigations, employee discipline and performance reviews, diversity initiatives, HR compliance, offer letters and applicant tracking, employee training, compensation and wage & hour issues, contingent workforce issues, contentious separations, litigations and arbitrations.

James P. Duffy IV

J.P. is a globally recognized international arbitration practitioner who handles all aspects of the international arbitration life-cycle, from strategic clause drafting and investment treaty structuring, to the merits phase and award enforcement. He has represented clients across a range of industries in international arbitrations under the ICC, AAA/ICDR, LCIA, HKIAC, SIAC, DIAC, JAMS, GAFTA, ICSID and UNCITRAL rules in the U.S., Europe, Asia, Africa and Latin America and handles arbitration-related litigation, such as actions for interim relief in aid of arbitration, award enforcement, and 1782 actions. In addition to his counsel work, J.P. also routinely sits as an arbitrator in commercial disputes and is listed on the arbitrator rosters of many arbitral institutions.
